Terms of Service

1. The Service

Field is an event management platform that enables event organizers to create and manage sporting events, process registrations, collect payments, and communicate with participants. Participants may use the Service to register for events, receive tickets, and manage their registration history.

2. Accounts and Eligibility

Organizer accounts: To create events and access organizer features, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Participant access: Participants may register for events without creating an account. By submitting a registration, you agree to these Terms.

Age: You must be at least 18 years old to create an organizer account or register for events independently. Individuals under 18 may participate in events where their parent or legal guardian has registered them or consented to their registration. By registering a minor for an event, you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

3. Organizer Responsibilities

If you use Field to organize events, you agree that you are solely responsible for:

• The accuracy of all event information you publish, including dates, locations, pricing, and descriptions
• Obtaining any permits, licenses, or insurance required to hold your event
• The safety and conduct of your event
• Communicating your refund policy to participants clearly before registration
• Fulfilling the event as advertised, or providing refunds in accordance with your stated refund policy
• Complying with all applicable laws, including consumer protection laws, data protection laws, and laws governing the collection and use of participant data
• Any custom registration form fields you create and the data you collect through them

Field is a technology platform and is not an organizer, co-organizer, or sponsor of any event listed on the Service.

4. Payments and Fees

Platform fees: Field charges a platform fee of 2% + $0.50 per completed registration transaction. This fee is deducted automatically from each transaction before payout to the organizer. There are no monthly fees, setup fees, or hidden charges.

Payment processing: Payments are processed by Stripe, Inc. By using the payment features of the Service, you agree to Stripe's Terms of Service. Field does not store payment card information.

Payouts: Organizer payouts are processed according to the payout schedule established during Stripe Connect onboarding. Field is not responsible for delays caused by Stripe or by banking institutions.

Free events: Field does not charge platform fees on free (zero-cost) registrations.

5. Refunds

Organizer refund policy: Each event organizer sets their own refund policy. Field is not responsible for issuing refunds to participants. Refund disputes are between the participant and the organizer. Field may facilitate refund processing through the platform at the organizer's direction, but does not guarantee or fund refunds.

Platform fees: Field's 2% + $0.50 platform fee is non-refundable once a transaction has been processed, except in cases of verified fraud or platform error.

If you believe an organizer has failed to honor their stated refund policy, contact us at hello@fieldevents.co and we will make reasonable efforts to assist in resolution, but we do not guarantee outcomes.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Create fraudulent events or collect registrations for events you do not intend to hold
• Misrepresent your identity or affiliation
• Attempt to access, modify, or interfere with another user's account or data
• Use automated tools to scrape, crawl, or extract data from the Service without permission
• Upload malicious code or attempt to compromise the security of the Service
• Use the Service to send unsolicited commercial communications
• Violate any third party's intellectual property, privacy, or other rights

7. Intellectual Property

Field and its associated logos, design, and content are the property of TK Growth LLC. You may not reproduce, distribute, or create derivative works without our written permission.

Event organizers retain ownership of their event content, including event descriptions, images, and registration form configurations. By posting content on the Service, you grant Field a non-exclusive, worldwide license to display and distribute that content as necessary to operate the Service.

8. Privacy

Our Privacy Policy, available at fieldevents.co/privacy, is incorporated into these Terms by reference and describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FIELD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

FIELD IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, OR DATA OF ANY EVENT ORGANIZER OR PARTICIPANT. YOUR USE OF THE SERVICE AND ATTENDANCE AT ANY EVENT IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TK GROWTH LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO FIELD IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

11. Indemnification

You agree to indemnify and hold harmless TK Growth LLC and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting hello@fieldevents.co. Termination does not affect any rights or obligations that arose prior to termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance.
